Divorce in the State of Texas

Marriage is a very simple concept in Texas: Either you are married or you aren't.

Texas is a no-fault divorce state and does not recognize legal separations. Dissolution of marriage is considered serious business by the state, and it is not a process that is settled overnight.

While Texas law requires a 60-day cooling-off period before a divorce can be finalized, the actions taken in the beginning of a divorce set the tone for how your case plays out.

Property

Texas recognizes two categories of property: Separate and Community. Separate property is defined as

  • Things you owned before the marriage
  • Things your spouse owned before the marriage
  • Things you inherited
  • Gifts given outright to you during the marriage, otherwise Gifts to both of you are one-half your separate property and one-half your spouse's separate property

Community property, which is the initial presumption in Texas, is defined as

  • Things you accumulated during the marriage

The best way to find satisfactory solutions to property division is by negotiating and coming to a joint agreement on how property will be divided, and we can put strong techniques in place that can help you. But, not every divorce can be negotiated, and when it is time to fight, I am ready to take your case before a judge.
